1) All equipment is the exclusive property of Cellphone Rentals Ltd and is suitable for use in New Zealand (within cellular access areas) to make and receive local and international phone calls and services. Some equipment is suitable for International roaming in which case the set-up is the responsibility of the customer. All telecommunication services are provided by external carriers and are subject to those carriers' terms and conditions.
2) The customer agrees to pre-pay:
a) Minimum 4-day rental charge (includes $5 worth of low-cost calls and delivery/return charges), plus an additional daily rental as required.
b) bond (refundable subject to Clause 5).
3) If the equipment is used for any illegal purpose or in violation of any relevant NZ or foreign regulation, the phone service and this rental agreement will be terminated without notice and the customer will forfeit all pre-pay sums (Clause 2).
4) In the event of equipment failure:
a) the customer must return all the equipment immediately.
b) Cellphone Rentals Ltd will, on return of the equipment:
i) provide replacement equipment, or...
ii) refund the bond and the unused daily rental charges in excess of the minimum sum.
5) If the equipment is not returned in original condition as a result of loss or damage, or any alteration to its security settings, the customer shall forfeit all or part of the bond as determined by Cellphone Rentals Ltd and no refunds will be given.
6) On return of the equipment, the customer:
a) is charged for any unpaid daily rental fees and for restoring mailbox.
b) is charged (at cost) for calls and services using the Telecom / Vodafone cellular communication network.
c) is refunded the bond subject to Clause 5.
d) is emailed a summary of rental and call charges on request
7) In no event shall Cellphone Rentals Ltd, or its agents be liable for any damages whatsoever (including but not limited to direct, indirect, incidental, consequential or financial loss) arising out of this rental agreement, the use or inability to use this equipment, network faults or violation of any relevant regulation.
